Terms of Service

Acceptance

By installing, activating, or using GeoGhost (the "Software") you agree to these Terms. If you do not agree, do not use the Software. The refund page sets out our refund policy.

These Terms are an agreement between you and the operators of GeoGhost (the "Team"). The Team is reachable at support@geoghost.gg.

Immediate delivery and withdrawal waiver

GeoGhost is digital content delivered immediately. By completing checkout and ticking the agreement checkbox on the payment page, you expressly request that delivery of your license key begin at once and you acknowledge that you thereby lose your statutory right of withdrawal that would otherwise apply under the laws implementing Directive 2011/83/EU, in particular Article 16(m), to consumers in the European Economic Area. The same applies under equivalent consumer-protection regimes in other jurisdictions where the right exists.

This waiver is a condition of sale. We cannot release a key without it. Once delivery has begun, the sale is final and the refund policy applies in full.

License

Subject to your payment of the applicable fee and continued compliance with these Terms, the Team grants you a non-exclusive, non-transferable, non-sublicensable, revocable license to install and use the Software on devices you personally control, for the duration of the access window you purchased.

The license is per natural person. A key is for your use. Sharing a key, reselling a key, or distributing the Software is a material breach of these Terms and will result in revocation without refund.

Restrictions

You agree not to:

• Reverse engineer, decompile, disassemble, or otherwise attempt to derive the source code, except to the extent expressly permitted by applicable law;
• Modify, adapt, or create derivative works of the Software;
• Remove or alter any proprietary notices, brand marks, or attribution;
• Use the Software to violate any applicable law;
• Use the Software to harass, harm, or defraud another person;
• Resell, sublicense, lease, or distribute the Software or any license key.

Third-party services

GeoGuessr is a separate product owned by a separate company. The Team is not affiliated with, endorsed by, or sponsored by GeoGuessr AB. Your use of the GeoGuessr service is governed by GeoGuessr's terms, which you accept independently. The Team makes no representation that use of the Software complies with GeoGuessr's terms. You are responsible for your own compliance with any third-party agreement you are bound by.

No warranty

The Software is provided "as is" and "as available", without warranty of any kind, express or implied, including but not limited to the warranties of merchantability, fitness for a particular purpose, and non-infringement. The Team does not warrant that the Software will be uninterrupted, error-free, or that any data will be preserved.

Limitation of liability

To the maximum extent permitted by applicable law, in no event shall the Team be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenues, data, goodwill, or other intangible losses, arising from or related to your use of, or inability to use, the Software.

The Team's aggregate liability to you for any claim arising from these Terms or your use of the Software shall not exceed the amount you paid for your current access window in the twelve months preceding the claim.

Termination

These Terms apply for the duration of your access window. The Team may terminate or suspend your license at any time, with or without notice, for any breach of these Terms. Termination for breach does not entitle you to a refund.

You may stop using the Software at any time. Stopping use does not entitle you to a refund.

Changes

The Team may revise these Terms from time to time. Material changes will be communicated by updating the date at the top of this page and, where appropriate, by email to active users. Continued use of the Software after a revision constitutes acceptance of the revised Terms.

Governing law

These Terms are governed by the laws of the jurisdiction in which the operating entity is registered, without regard to conflict-of-law principles. Any dispute arising out of or related to these Terms shall be subject to the exclusive jurisdiction of the courts of that jurisdiction.
